SUPORTADO ng commuter at transport groups ang panawagan ni 1-Pacman Party-list Representative Mikee Romero na dapat ibalik ang ibinayad ng mga motorista na nahuli at pinatawan ng multa mula sa “No Contact Apprehension Policy” (NCAP).

Sa interview kay Atty. Ariel Inton, founder ng Lawyers for Commuters Safety and Protection (LCSP), sa ginawa niyang pagsusuri ng ordinance no. 3052 series of 2021 ng Quezon City at nakita rito ang kasagutan at dahil isa lang naman ang private contractor ng ibang local government unit (LGU) ay maaaring ganito rin ang tema.

Sa Section 4: “NCAP Trust Fund the fines and applicable surcharges and interest collected by the city government for violations identified and captured through the NCAP shall be placed in a No-Contact Apprehension Program Trust Fund which shall be separate and distinct from the traffic development trust fund, the city general fund, and all other trust funds made for other purposes.”

Sa pagpapatuloy, “The NCAP Trust Fund shall have its own bank account to which the city government has access for the implementation of the NCAP by the city government, on its own, or through a joint venture, service agreement, or other applicable modes.”

Ayon kay Atty. Inton, “Ibig sabihin ang multa na nakolekta mula sa NCAP ay hindi napupunta sa general fund ng LGU kung hindi sa isang trust fund na hindi lamang ang LGU ang may access kundi puwede ang joint venture (Kasama ang private contractor?) service agreement or other mode.”

“So ‘pag enforcer ang nakahuli sa’yo, ang multa na binayaran mo ay sa general fund pero kapag sa NCAP, pasok ito sa NCAP Trust Fund,” paliwanag pa niya.

“Sino naman ang nangangasiwa sa NCAP Trust Fund kundi ito kabahagi ng general fund,” ani Atty. Inton.

Sa “Sec 5. Trust Fund Committee – The City Mayor shall create an NCAP Trust Fund Review and Approval Committee, which shall be responsible for the documentation and liquidation of the proceeds of the NCAP Trust Fund, subject to the applicable rules and regulations of the Commission on Audit and other applicable laws… Monthly honoraria may be given to the members and secretariat of the NCAP Trust Fund Review and Approval Committee, as may be determined by the City Mayor,” sinabi ni Inton na “magiging madali ang refund dahil sa wala sa general fund ang mga binayad na multa. Pero bakit sa Trust Fund nilagay at hindi sa general fund? [Okay] ba sa COA [Commission on Audit] ito?”

“Marahil kailangan din malaman ng publiko kung sino ang mga tao na in-appoint para pangasiwaan ang NCAP Trust Fund,” suhestiyon ni Inton.

“Nagalaw na ba ito? Dito ba manggagaling ang parte ng private contractor?” dagdag pa niya.

“Marahil sa panawagan ng refund NCAP payments malalaman natin ang sagot sa mga tanong na ito para maproteksyunan natin ang perang ibinayad sa mga multa ng NCAP kahit ang mga violations ay tinututulan… Wala na lang talagang magawa ang mga ibang motorista at operator dahil sa inalarma ng LTO [Land Transportation Office] ang rehistro ng mga sasakyan nila,” pagtatapos ni Inton.
