Reklamo ng TVJ, kinontra ng TAPE: ‘It is not copyright infringement’

Naglabas na ng official statement ang Television and Production Exponents, Inc. (TAPE, Inc.) kaugnay ng reklamong copyright infringement and unfair competition na isinampa nina Tito Sotto, Vic Sotto and Joey de Leon laban sa nasabing kumpanya at sa GMA-7.

Sa inilabas na ulat ng “24 Oras,”ayon sa statement ng legal counsel ng TAPE, Inc. na si Atty. Maggie Garduque ay hindi pwedeng ireklamo ng copyright infringement ang kumpanya dahil ito ang registered owner ng pangalang “Eat Bulaga,” gayundin ang design ng logo nito.

“It is not a copyright infringement. ‘Eat Bulaga’ name, the design of the name and the logo is a trademark and not subject of copyright,” pahayag ng abogado.

“TAPE, Inc. has the registration of the tradename ‘Eat Bulaga’ so they cannot file infringement against the registered owner of the trademark. Their petition for cancellation of trademark of Eat Bulaga is still pending before the IPO and until such time that said petition is granted, the trademark Eat Bulaga and EB will be owned by TAPE, Inc.,” nakasaad pa sa statement.

Nauna nang nagbigay ng statement last Wednesday ang GMA-7 hinggil sa reklamo ng TVJ.

“We will refer the complaint to our legal counsel, Belo Gozon Elma Parel Asuncion and Lucila Law Offices,” pahayag ng GMA-7.

Nagsampa ng reklamo ang TVJ laban sa dalawang kumpanya sa Marikina Regional Trial Court noong June 30.
