Fiscal slay suspect flees after confession, rearrested

IMUS CITY, Cavite — After admitting to investigators his participation in the shooting of Trece Martires Assistant City Prosecutor Edilbert Mendoza during tactical interrogation, suspect Marvin Tagayon Linaban, 44, escaped from the custody of Provincial Drug Enforcement Unit (PDEU), at 9:30 a.m. on January 10, 2022 at Camp General Pantaleon Garcia in Barangay Poblacion here.

The suspect was re-arrested by Provincial Intelligence Unit (PIU/PDEU) personnel led by Police Captain John Mark Presbitero under Police Lt. Colonel Rodel Ban-O in Barangay Sna Miguel 2 at around 2:45 p.m. on the same date.

PNP chief Police General Dionardo Carlos reported on Sunday that Linaban was arrested during a drug buy-bust on January 7 in Dasmariñas City, along with another armed companion.

Libanan expressed remorse and willingness to make an extra-judicial confession regarding Mendoza whi was shot dead on December 31, 2021 outside his house in Brgy. Cabuco, Trece Martires City, Cavite while doing his morning exercises.

Police said Mendoza was shot in the head at around 7:30 a.m.

Linaban escaped after asking permission to use the comport while being guarded by Pcpl. Lynard Pareja and Pat. Dexter Tapawan.

After a few minutes, Pcpl. Pareja was pushed as he was about to handcuff Libanan.

The suspect then ran towards the creek.

Linaban and one Elvin Esguerra were arrested in Barangay H2, Dasmarinas City by Cavite Drug Enforcement Unit operatives at 10:30 p.m. on Friday.

Esguerra, 40, was wounded and arrested after an armed encounter with the arresting authorities. He was then taken to a local hospital.

During the buy-bust operation, the arresting team also confiscated several plastic sachets of shabu with an estimated value of P69,000.

Authorities also confiscated a .45 caliber Thompson Auto-Ordnance pistol and a 9mm pistol.

Both firearms have been submitted to the PNP Forensic laboratory for ballistics examination.
