Commercial court judges reminded to avoid delays in resolution of cases

THE Office of the Court Administrator reminded regional trial courts that were designated as commercial courts to strictly follow Section 72 of Republic Act No. 10142 (Rehabilitation or Liquidation of Financially Distressed Enterprises and Individuals) which required designated judges to act on the cases filed before them within one (1) year.

In OCA Circular No. 105-2021, Court Administrator Jose Midas P. Marquez reminded these judges that a violation “constitutes gross inefficiency and warrants the imposition of administrative sanctions against the erring magistrate.”

The Supreme Court has designated 147 regional trial courts as special commercial courts to handle cases like rehabilitation, insolvency, and liquidation filed by companies and other interested parties.

Marquez issued the circular in response to a letter from Finance Secretary Carlos G. Dominguez III who lamented the “questionable trend of unwarranted delay or circumvention of court proceedings” in the handling of commercial cases.
