
Clarify liability of MC taxi drivers — solon
PUWERSA ng Bayaning Atleta (PBA) Party-list Representative Margarita Nograles has raised the urgency of the immediate creation and implementation of comprehensive guidelines regarding the liability of motorcycle taxi drivers and operators in the unfortunate event of accidents.
Nograles lamented that even as the Department of Transportation (DOTR) allowed the interim operation of motorcycle taxi operators such as Grab / Move It, Joyride and Angkas, pending the approval of legislation on motorcycle taxis, there are still no clear guidelines, especially on the liability aspect of their operation.
“Even the pending bills that are currently being deliberated in Congress are silent about the aspect of liability,” Nograles said as she noted that there are even proposals to expand the coverage of these motorcycle taxis which are also known as “habal-habal. “
The lady solon said there is a need to prioritize safety and accountability over the economic benefits and convenience provided by these motorcycle taxis.
She emphasized that these concerns must be addressed first before considering any expansion of coverage or inclusion of additional players in the field.
“While discussing the possibility of expanding the scope and involving more players, shouldn’t we first address the fundamental question? Who should be held liable in case of accidents? What evidence is required? What level of diligence is expected? Are motorcycle taxis considered public utility vehicles or private ones? These are the realities that need proper scrutiny before broadening the scope or introducing more stakeholders,” Nograles said.
Nograles clarified that she has nothing against the operation of motorcycle taxi operations but safety should be a paramount concern, especially with the alarming increase in the number of accidents involving motorcycles.
