Topacio: Kawalan ng aksyon sa habeas corpus petition ng Pharmally executives ikinalungkot
IKINALUNGKOT ng kampo ng Pharmally executives ang kanilang patuloy na pagkakadetine sa Pasay City Jail at ang kawalan umano ng aksyon ng Court of Appeals (CA) sa kanilang inihaing writ of Habeas corpus petition.
Sa isang press conference, sinabi ni Pharmally legal counsel Atty. Ferdinand Topacio na Nobyembre 2021 nang maghain sila ng petisyon sa CA, makalipas ang limang buwan o nito lamang Marso 1, 2022 nagpalabas ng desisyon ang CA 5th Division sa ilalim nina Associate Justices Apolinario Bruselas Jr., Filomena Singh at Bonifacio Pascua.
Ayon kay Topacio sa resolusyon ng CA 5th Division ay sinabi nitong moot and academic na ang habeas petition ni Pharmally President Twinkle Dargani dahil pinalaya na ito ng Senado habang sa parehas na petisyon ni Pharmally Secretary Mohit Dargani ay wala pang desisyon.
“No further action need to be taken with respect to petitioner Twinkle Dargani, the petition as to her having been rendered moot and academic. Thus her petition is dismissed,” nakasaad sa dalawang pahinang resolusyon ng CA 5th Division na walang banggit sa kaso naman ni Mohit Dargani.
“Ang principle ng habeas corpus ay mabilisan ito because it deals with the person’s right to liberty. We are going public now with this issue kasi unusual na, its really unbearable, they have been languishing in jail for five months without any case filed against them in court,” paliwanag ni Topacio.
Sinabi ni Topacio na sa naging pagdinig sa Senado na hindi nabigyan ng pagkakataon ang kanyang mga kliyente na dumepensa o basahin man lamang ang kanilang statement at agad na kinasuhan ng contempt, nagpasaklolo sila sa CA ngunit wala ding aksyon.
“Remember only the three showed up and tried to give their testimony but were forbidden to speak up and give their side of the story. The Senate records will show that they were not even allowed to read their statements prior to the start of the hearings.Even more interesting is that the two remaining Pharmally executives have limited to no visitation rights, limited interactions and communications with their lawyers among other things, and they have not been charged with any crime.”
