Panibagong tagumpay ang nakamit nina Tito Sotto, Vic Sotto at Joey de Leon (TVJ) dahil kaninang hapon 4:23, January 5, ay lumabas na ang desisyon ng Marikina Regional Trial Court hinggil sa kasong copyright infringement and unfair competition na isinampa ng iconic trio laban sa Television and Production Exponent, Inc. (TAPE, Inc.).

Pumabor ang korte sa TVJ at maaari na nilang gamitin ang titulong “Eat Bulaga.”

Base sa desisyon ng korte, ang TVJ ang may-ari ng titulong “Eat Bulaga” at si Joey ang talagang nakaisip ng nasabing titulo. Pinagbabawalan na rin ng korte ang TAPE at GMA-7 na gamitin ang trademark na “EB” at “Eat Bulaga.”

“In view of defendant TAPE’s failure to make a categorical and specific denial of the claim of Joey that he coined, formulated, and worded the title Eat Bulaga including the specific explanation how such a portmanteau was created, given the millions of words in the dictionary, the court, therefore, rules that plaintiffs have successfully proved and established, by preponderance of evidence, that Joey and his co-plaintiffs Tito and Vic should be credited with the formulation and creation of the mark Eat Bulaga,” ang nakasaad sa desisyon.

Ipinahayag din ng korte na kahit umapela pa ang GMA at TAPE ay hindi na nila maaaring gamitin ang “Eat Bulaga” title.

“Under the 2020 Revised Rules of Procedure for Intellectual Property Rights Cases, any order issued by the court is immediately executory. This means that the RTC’s ruling will already be enforced even if TAPE or GMA files an appeal,” ang bahagi ng desisyon.

Masayang-masaya ang TVJ sa kanilang tagumpay at hindi napigilang maging emosyonal sa kanilang ini-release na statement.

“Nanalo po tayo. Bottomline, kinatigan po ng korte ang aming sinasabi na tayo po ang may-ari ng Eat Bulaga,” pahayag ni Tito Sen sa isang video.

Emosyonal pang sabi ni Tito Sen, “Maraming salamat sa pagtangkilik, maraming salamat sa mga dasal, unang-una sa lahat, sa Panginoong Diyos, thank you very much.”
