Gadon challenges Carpio to debate on estate tsx issue

UNITEAM senatorial candidate lawyer Larry Gadon has challenged fellow law practitioner Antonio Carpio in a debate to prove that the latter was ignorant of taxation law and that his allegations relative to the Marcos family’s estate tax were nothing but mere political propaganda.

Gadon said that Carpio who has turned into a virtual mouthpiece of the dilawans with his incorrect and misleading conclusions and presumptions on the Marcos estate tax issue, should instead face him in a debate.

“Masyado mong nililito ang tao. Ang dapat sa’yo hindi na tawaging attorney kasi hindi na gawain ng isang abogado iyang ginagawa mo kundi gawain na ng isang propagandista,” Gadon added.

He explained that it was a big mistake for Carpio to accuse Marcos of non-payment of the P203 billion estate tax because “first, there was no specific detail of how and where the P203 billion was computed”.

Second, the subject tax is not BBM’s liability but of the Marcos Estate’s because individual taxpayers like BBM and estates like the Marcos Estate has its own juridical personality, and consequently has its own tax identification number.

He said, in other words, the one who should pay the tax, if there is one, is the estate itself of former president Ferdinand E. Marcos, Sr.

“Kahit sina First Lady Imelda Marcos, Senator Imee at Madam Irene Marcos-Araneta ay hindi rin puwedeng singilin sa estate tax dahil hindi pa nila ito pag-aari. Iyan ang tunay na isyu at huwag mong ibahin ang isyu propagandistang Carpio. Nagmumukha kang bobo dahil sa frustration n’yong talunin si BBM ngayong election,” according to Gadon.

“Saka bakit mo babayaran ang estate tax kung kinukuwestiyon n’yo kung totoo ba na pag-aari ito ng mga Marcos? Ano baliw, magbabayad ka ng tax na hindi pa naman siguradong ari-arian mo nga iyon? Ang tatanga talaga ng dilawan!” he added.

The YouTube sensation lawyer emphasized that no one gets imprisoned for failing to pay taxes at any time or place.

“Parang amilyar sa lupa lang iyan. Ibig sabihin kapag hindi tayo nakabayad ng amilyar sa lupa natin, ikukulong na natin? Hindi ba ireremata lang ito ng gobyerno?” said Gadon.

“Para magkaalaman na kung sino sa atin ang tanga at bobo, magdebate na lang tayo, propagandistang Carpio!” he continued.

To rtecall, former Senate President Juan Ponce Enrile recently chastised Carpio for serving as a propagandist for Marcos’ opponents.

Enrile insisted that there was no other motive for the estate tax problem than politics, especially since the elections are barely a month away on May 9.

“Alam ninyo, mga kababayan pulitika ngayon eh bago kayo maghusga, bago kayo maniwala, makinig kayo. Bago kayo maniwala isipin muna ninyo kung totoo yung sinasabi ng mga tao na yan,” said Enrile.

“Kahit na ex-Supreme Court Justice (Carpio) kung hindi nya napag-aralan iyan at hindi nya naintindihan at hindi nya prinaktis sa kanyang pagiging abogado, hindi nya naintindihan yan,” former senator added.

Enrile is a taxation law expert with a master’s degree in taxation law from Harvard.
