DU30 signs law giving survivorship benefits to prosecutors

PRESIDENT Rodrigo Duterte has signed into law Republic Act No. 11643 or the National Prosecution Service Act granting survivorship benefits to the surviving legitimate spouse and dependent children of a deceased retired government prosecutor.

RA 11643 will enable the qualified heirs to receive all the retirement benefits of the deceased prosecutor. The benefits provided in the law are also available to the qualified heirs of prosecutors who are already eligible to retire optionally at the time of their death.

Likewise, the law provides for a retroactive application for prosecutors who died one (1) year prior to its effectivity, in order to allow the widest and most meaningful application of the law for the intended beneficiaries.

The NPS welcomed this development and is truly grateful to President Duterte, the members of the Congress, both the House of Representatives and Senate of the Philippines, and all the key persons instrumental to the swift enactment of the law.

“It comes at a most crucial time where the pillars of justice are tested by the ongoing attacks against prosecutors, coupled with the continuing health crisis.

“Indeed, the passing of the law is a milestone for the entire NPS and will uplift the morale of all prosecutors who risk their lives and personal safety in furtherance of the administration of justice,” the DOJ said.

R.A. No. 11643 will become effective 15 days after its publication in the Official Gazette or in a newspaper of general circulation.
