Court corrects male birth record as female

A WOMAN named Kenneth will finally be allowed to have her gender corrected in her official records after state lawyers withdrew their appeal before the Court of Appeals (CA).

In a resolution dated October 29 and written by Associate Justice Marilyn Lagura-Yap, the CA granted the withdrawal of the appeal filed by the Office of the Solicitor General (OSG) on the decision of the Lapu-Lapu City Regional Trial Court (RTC) Branch 54) regarding the correction of the birth record of case Kenneth Lambojon Delfin, who was recorded as “male”.

Among the evidence was a medical certification by Dr. Rodolfo Berame which states that “upon examination, Kenneth is indeed female”.

Berame also certified that there was no indication that she had undergone sex change medical procedure and submitted a sonographic report with images describing the female organs.

The OSG said it was initially not furnished with copies of the pleadings and evidence while it was still in the RTC, prompting it to file “a notice of appeal as a precaution”.

After the court records were finally provided, the OSG said its “perusal of the records reveals that the correction in Delfin’s certificate is warranted”.

“In view of the foregoing evidence presented during trial, the OSG said it “now believes that the petitioner-appellee has sufficiently proven her sex as female instead of male, thereby warranting the necessary correction in her certificate of live birth”. Philippine News Agency
